These Terms and Conditions apply to different MindMotive products and services. Specific terms for each product are set out below.

Talk It Through – Terms and Conditions

These Terms apply specifically to the Talk It Through tool accessed via the MindMotive website.Terms and conditions – Specific to the use of the Talk It Through tool.

These Terms and Conditions (“Terms”) govern your access to and use of Talk It Through (the “Tool”), provided by MindMotive (“we”, “us”, “our”). By purchasing, accessing, or using the Tool, you agree to be bound by these Terms.

If you do not agree, you should not use the Tool.

1. Nature of the Tool

Talk It Through is an AI-based reflective tool designed to help users explore thoughts, perspectives, and situations through structured reflection.
The Tool generates dynamic responses based on user input. Outputs are not pre-written, may vary between users, and are not guaranteed to be accurate, complete, or appropriate for any specific situation.

The Tool is provided for informational and reflective purposes only.

2. Not Professional Advice

The Tool does not provide medical, psychological, legal, financial, or other professional advice.

Nothing generated by the Tool should be relied upon as a substitute for professional judgement, diagnosis, or decision-making.

You should seek appropriate qualified professional support where needed.

3. Not Suitable for Crisis Situations

The Tool is not designed for use in crisis situations or where urgent support is required.

It is not appropriate for use where you may be at risk or require immediate assistance.

If you require urgent help, you should contact appropriate emergency services or a qualified professional immediately.

4. User Responsibility and Non-Reliance

You are solely responsible for how you use the Tool and how you interpret or act on any outputs.

By using the Tool, you agree that:
You use it at your own risk
You will not rely on it as a source of advice or decision-making authority
You are responsible for any actions, decisions, or outcomes resulting from its use

5. Accounts and Access

To use the Tool, you must create an account.

You agree that:
Your account is for your personal use only
You will not share your login details with others
You are responsible for all activity under your account

We reserve the right to suspend or terminate access where misuse, abuse, or unauthorised sharing is suspected.

You agree not to share, distribute, or make your account accessible to any other person. Unauthorised sharing of access may result in immediate suspension or termination of your account without notice.

Where unauthorised sharing or misuse results in excessive usage, financial loss, or disruption to the service, MindMotive reserves the right to take further action, including recovery of costs and/or legal action where appropriate.

6. Subscription and Usage Limits

Access to the Tool is provided on a subscription basis.
Your subscription includes a limit of 30 messages per 24-hour period. A “message” is defined as one user input and one AI response.
Usage limits are in place to ensure fair access and system performance. We reserve the right to modify these limits where reasonably necessary.
Unused messages do not roll over.

7. Data Use and Session Storage

User inputs and AI responses are stored temporarily during an active session to enable functionality.
Data is not retained beyond the session unless otherwise stated.

You are responsible for the content you input and should not enter information that you are not comfortable sharing in a digital environment.

8. No Refund Policy

Due to the digital nature of the Tool and immediate access provided upon purchase, all sales are final.

By purchasing, you:
expressly request immediate access to the Tool, and
acknowledge that you lose your statutory right to cancel under the Consumer Contracts Regulations once access is granted
No refunds, cancellations, or exchanges will be provided after access has been given.

9. Acceptable Use

You agree not to:
Use the Tool for unlawful purposes
Attempt to exploit, reverse engineer, or interfere with the Tool
Use the Tool in a way that could harm, disrupt, or degrade the service

You agree not to:

Misrepresent the Tool, its purpose, or its outputs
Share false, misleading, or deliberately inaccurate information about the Tool
Use the Tool or its outputs in a way that could harm, mislead, or damage the reputation of MindMotive or its products
Present outputs from the Tool out of context in a way that creates a misleading impression

Any breach of these terms may result in immediate suspension or termination of access. Where misuse, misrepresentation, or harmful use results in reputational damage, financial loss, or disruption to the service, MindMotive reserves the right to pursue appropriate legal remedies.

10. Limitation of Liability

To the fullest extent permitted by UK law, we shall not be liable for:
Any decisions made or actions taken based on use of the Tool
Any reliance placed on outputs generated by the Tool
Any indirect, incidental, or consequential loss
Loss of income, business, data, or opportunity

Our total liability for any claim relating to the Tool shall be limited to the amount paid by you for the subscription in the relevant billing period.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or any liability which cannot be excluded under UK law.

11. Availability

We aim to provide continuous access to the Tool but do not guarantee uninterrupted or error-free service.
We are not responsible for downtime, interruptions, or technical issues outside our control.

12. Intellectual Property and Content Use

All content, structure, and functionality of the Tool remain the intellectual property of MindMotive.
You agree not to copy, reproduce, distribute, or publicly share any part of the Tool or its outputs.

This includes, but is not limited to:

  • screenshots or recordings of the Tool
  • AI-generated responses
  • any part of the structure, prompts, or functionality

The Tool is designed for private, personal use. Content generated through the Tool is intended for your own reflection and should not be shared, published, or distributed without prior written permission.

13. Jurisdiction and Use

These Terms are governed by the laws of England and Wales.

The Tool is intended for use by individuals based in the United Kingdom. If you access or use the Tool from outside the UK, you do so at your own risk and are responsible for compliance with any applicable local laws.

MindMotive makes no representations that the Tool is appropriate for use in other jurisdictions and accepts no responsibility for use outside the UK.

14. Changes to the Tool and Terms

We reserve the right to modify or discontinue the Tool, or update these Terms, at any time.
Continued use of the Tool constitutes acceptance of any updated Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By accessing or using Digital Partners, you agree to be bound by these Terms.

If you do not agree, you should not use them.

  1. Nature of Digital Partners

Digital Partners are AI-based tools designed to support structured reflection, insight, and exploration of real-life situations.

They generate dynamic responses based on user input. Outputs are not pre-written, may vary between users, and are not guaranteed to be accurate, complete, or appropriate for any specific situation.

The Tools are provided for informational and reflective purposes only.

  1. Not Professional Advice

Digital Partners may offer perspectives, questions, or suggested directions.

These are for consideration only and should not be relied on as professional advice or a substitute for professional judgement.

They do not provide medical, psychological, legal, financial, or other regulated services.

You should seek appropriate qualified professional support where needed.

  1. Not Suitable for Urgent or High-Risk Situations

Digital Partners are not designed for use in situations where immediate or urgent support is required.

If you are at risk or require urgent assistance, you should contact appropriate emergency services or a qualified professional.

  1. User Responsibility and Non-Reliance

You are solely responsible for how you use Digital Partners and how you interpret or act on any outputs.

By using the Tools, you agree that:

  • You use them at your own risk
  • You will not rely on them as a source of advice or decision-making authority

  1. Platform Use (ChatGPT)

Digital Partners are accessed via ChatGPT, which is a third-party platform.

We do not control ChatGPT and are not responsible for:

  • its availability or performance
  • how it processes, stores, or handles data
  • any changes made to the platform or its functionality

Your use of ChatGPT is also subject to its own terms and policies.

  1. Access and Licensing

Access to Digital Partners is provided under licence, unless otherwise stated.

Licences are issued for individual use only and must not be shared, distributed, or resold.

7. Acceptable Use

You agree not to:
Misrepresent the Tool, its purpose, or its outputs
Share false, misleading, or deliberately inaccurate information about the Tool
Use the Tool or its outputs in a way that could harm, mislead, or damage the reputation of MindMotive or its products
Present outputs from the Tool out of context in a way that creates a misleading impression

We reserve the right to restrict or terminate access where misuse is identified.

8. Availability

We do not guarantee that Digital Partners will be available at all times.

Access may be affected by changes, limitations, or disruptions to ChatGPT.

9. Limitation of Liability

To the fullest extent permitted by UK law, we shall not be liable for:

  • any decisions made or actions taken based on use of Digital Partners
  • any reliance placed on outputs
  • any indirect, incidental, or consequential loss
  • loss of income, business, data, or opportunity

We reserve the right to modify, update, or withdraw Digital Partners at any time.

We may also update these Terms from time to time.
