MindMotive / MindMotiveAI – Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of MindMotive / MindMotiveAI products and services, including Talk It Through, Otto, and Digital Partners (collectively referred to as the “Tools”).
By purchasing, accessing, or using any MindMotive Tool, you agree to be bound by these Terms.
If you do not agree, you should not use the Tools.
1. Eligibility
The Tools are intended for use by individuals aged 18 and over.
By using the Tools, you confirm that you meet this requirement.
2. Nature of the Tools
MindMotive provides AI-based tools designed to support structured thinking, reflection, and the exploration of real-life situations.
The Tools generate dynamic responses based on user input. Outputs are not pre-written, may vary between users, and are not guaranteed to be accurate, complete, or appropriate for any specific situation.
All Tools are provided for informational and reflective purposes.
3. Not Professional Advice
The Tools do not provide medical, psychological, legal, financial, or other regulated professional advice.
While the Tools may offer perspectives, suggestions, or possible approaches where appropriate, these should not be relied upon as a substitute for professional judgement or decision-making.
You should seek appropriate qualified professional support where needed.
4. Not Suitable for Crisis or High-Risk Situations
The Tools are not designed for use in crisis situations or where urgent support is required.
If you are at risk or require immediate assistance, you should contact appropriate emergency services or a qualified professional.
5. User Responsibility and Non-Reliance
You are solely responsible for how you use the Tools and how you interpret or act on any outputs.
By using the Tools, you agree that:
- you use them at your own risk
- you are responsible for any actions, decisions, or outcomes resulting from their use
- you will not treat outputs as authoritative or definitive
6. Talk It Through – Specific Terms
Talk It Through is accessed via the MindMotive website and requires an account.
Accounts and Access
- Accounts are for personal use only
- Login details must not be shared
- You are responsible for all activity under your account
We reserve the right to suspend or terminate access where misuse or unauthorised sharing is suspected.
Subscription and Usage
- Access is provided on a subscription basis
- Usage is limited to 30 messages per 24-hour period
- A “message” is defined as one user input and one AI response
- Unused messages do not roll over
We may modify usage limits where reasonably necessary.
Data Use (Talk It Through only)
- Inputs and responses are stored temporarily during an active session
- Data is not retained beyond the session unless otherwise stated
We may use anonymised, non-identifiable data to improve the Tool.
You should not input information you are not comfortable sharing in a digital environment.
Refunds
Due to the digital nature of the Tool and immediate access provided:
- all sales are final
- you expressly request immediate access
- you acknowledge that you lose your statutory right to cancel once access is granted
No refunds, cancellations, or exchanges will be provided after access.
7. Otto – Specific Terms
Otto is a Digital Partner provided under a paid subscription model.
Access and Payment
- Access is provided on a recurring subscription unless otherwise stated
- Subscription terms, pricing, and billing are set out at the point of purchase
- Access may be withdrawn if payment fails or is cancelled
Nature of Use
Otto provides real-time support for working through situations based on user input.
Outputs:
- are generated dynamically
- are not fixed or guaranteed
- will vary depending on the user and context
Platform Use (ChatGPT)
Otto is accessed via ChatGPT, a third-party platform.
We are not responsible for:
- platform availability or performance
- how data is processed or stored by the platform
- changes made to the platform
Your use of ChatGPT is also subject to its own terms and policies.
Licensing
- Access is provided for individual use only
- It must not be shared, distributed, or resold
8. Digital Partners – General Terms
Digital Partners are AI-based tools designed to support structured thinking and the exploration of real-life situations.
They:
- respond dynamically to user input
- may offer perspectives, suggestions, or possible approaches where appropriate
- are intended to support thinking, not replace it
Access is provided under licence unless otherwise stated and is for individual use only.
9. Acceptable Use
You agree not to:
- use the Tools for unlawful purposes
- attempt to exploit, reverse engineer, or interfere with the Tools
- misrepresent the Tools, their purpose, or outputs
- share misleading or inaccurate information about them
- use outputs in a way that could cause harm or reputational damage
- present outputs out of context in a misleading way
We reserve the right to suspend or terminate access where misuse is identified.
Where misuse results in financial loss, reputational damage, or disruption, we reserve the right to pursue appropriate legal remedies.
10. Intellectual Property
All content, structure, systems, and functionality of the Tools remain the intellectual property of MindMotive / MindMotiveAI.
Content Use and Sharing
Outputs generated by the Tools are provided for personal use only.
You may:
- use outputs for your own private reflection and decision-making
You may not:
- reproduce, distribute, or publish outputs in full on public platforms
- use outputs as part of any commercial product, service, or offering
- present outputs as your own work or methodology
- systematically share or republish outputs in a way that replicates the Tool
Limited excerpts may be shared for personal, non-commercial purposes, provided they are not presented out of context or in a misleading way.
We reserve the right to restrict or take action where content is used in a way that undermines or replicates the Tool.
11. Availability
We aim to provide continuous access but do not guarantee uninterrupted or error-free service.
We are not responsible for downtime, interruptions, or issues outside our control, including those relating to third-party platforms.
12. Limitation of Liability
To the fullest extent permitted by UK law, we shall not be liable for:
- decisions made or actions taken based on use of the Tools
- reliance placed on outputs
- indirect, incidental, or consequential loss
- loss of income, business, data, or opportunity
Our total liability is limited to the amount paid by you in the relevant billing period.
Nothing in these Terms excludes liability that cannot be excluded under UK law.
13. Changes to the Tools and Terms
We reserve the right to:
- modify, update, or discontinue any Tool
- update these Terms at any time
Continued use constitutes acceptance of any updated Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
